Jennifer A. Tomlin counsels large and small employers across the country regarding California employment law compliance and best practices. Her practice focuses on helping employers understand the intricacies of California and US labor laws and implement policies and procedures to comply with employment law. It is often difficult for employers, including start-ups, to effectively appreciate myriad of laws and regulations concerning their employees’ rights and obligations. Ms. Tomlin works with her clients to understand their legal obligations, as well as options and risks, while taking into account the nature, culture, and financial aspects of their businesses.
Ms. Tomlin provides advice and counseling regarding hiring, discipline, termination, wage/hour compliance, investigations, leaves of absence, discrimination, harassment, independent contractor worker issues, and litigation strategy. Ms. Tomlin also drafts Handbooks and other workplace policies, as well as offer letters, job descriptions, and severance agreements.
Ms. Tomlin represents employers against administrative charges filed before the California Department of Labor Standards Enforcement and Department of Fair Employment and Housing, and the Equal Opportunity Commission, and regularly responds to demand letters from employee counsel. She also conducts workplace investigations regarding discrimination and harassment claims.
Ms. Tomlin previously worked as an employment defense litigator at a worldwide law firm, where she defended employers before US federal and state trial courts and before administrative agencies. She represented employers in large and small single-plaintiff and class action employment disputes involving complex wage and hour claims, wrongful termination, retaliation, harassment, and discrimination issues.
Jennifer earned her J.D. from University of California, Davis School of Law in 2008, and earned a BA in History from University of California, Santa Barbara in 2004.
